All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions. Following receipt of your order ,we will send to you an order acknowledgement email detailing the products you have ordered.Please note that this email is not an order acceptance from The Bike Shop (Leeds) Ltd. Acceptance of your order and the completion of the contract between you and us will take place on dispatch of the products ordered unless we have notified you that we do not accept your order or you have cancelled it. We accept all major credit/debit cards - except American Express. We also accept payment by Paypal. Cheques should be made payable to The Bike Shop (Leeds) Ltd. and posted to us at 78-84 Crossgates Road,Leeds,LS15 7NL. The price for the goods will be as stipulated on the website at the time when you place your order. If due to an error or omission, the price published for the goods on our website is wrong, we will inform you of the correct price and give you an opportunity to either cancel, or proceed with the order at the correct price.

Shipping and Handling

Where we offer Free standard delivery,this is for week days only and does not include week ends. Deliveries to the Highlands and Off shore addresses is not currently available. If the goods are returned as Non Warranty. i.e. you have changed your mind,you will be responsible for the cost of, and safe return of, all items to us.Goods should be returned in their original packaging and in an unused and re-saleable condition. Your order for goods is subject to availability. If we are not able to supply the goods to you for any reason after 28 days, we will on request reimburse you for those goods. However, we will not be responsible for compensating you for any other losses, which you may suffer if we do not supply goods. When our carriers deliver the goods, they will require you to sign for them. If neither you, nor your representative are able to receive the goods, our carrier will leave a card to advise that they will attempt the delivery again,or requesting you to contact them or visit their nearest depot to collect your order. If they are unable to deliver on the second attempt, you will be charged a further £12.50 for a third and every subsequent attempt. Should this situation arise,we will contact you to collect your payment , the couriers will not release the goods until we have confirmed that payment has been received. Items are usually dispatched within 2 working days.We make every effort to deliver goods within the estimated dispatch timescales,however,delays are occasionally inevitable due to unforseen factors. We are under no liability for any delay or failure to deliver products within estimated timescales caused by circumstances beyond our reasonable control. However,in accordance with the Distance Selling Regulations all orders will be fulfilled within a maximum of 30 days or a full refund will be issued. If you have received any email from us confirming that your goods have been despatched,please let us know by replying to our email,if you have not received your order within 3 working days. Deliveries are usually made between 8am and 6pm on weekdays.It is not possible to enquire about a delivery until the following day. Delivery is arranged on your behalf as a courtesy and forms no part of our contract to supply goods within a specified timescale.

Your Security and Credit Card Security

We value your security and as such have done our utmost to ensure that none of your personal information is at risk while you are visiting our site. CREDIT CARD SECURITY: Because of the threat to the security of your payment details, we will not request your credit card details via the standard order form. You will be contacted within 48 hours to confirm your payment details, thus ensuring that at no point are your details stored in any transmission across the internet. If you select to use our secure server option, you will be transferred to the secure server prior to your payment details being requested. The secure server uses 128 bit encryption and as such you can feel confident that your details cannot be intercepted by any third party at any point during the transaction. If you select to use our credit application facility, once again your details are only transferred via a 128 bit encrypted connection. Please note when placing your card details onto the secure server, please use your billing address. If you use a delivery address our credit card facility will decline this and we will then have to phone the card company for authorization. Each time we do this we are charged £3 this charge will be made to the customer. Therefore please make sure that you use the correct information.

Our returns and refunds policy is in accordance with the EU Distance Selling Directive which came into force in October 2000 and is part of UK law under the Consumer Protection (Distance Selling) Regulations 2000.This law applies to all transactions within the UK where a consumer does not meet the seller.Contracts between businesses are not governed bt these regulations. Consumers have the option to change their mind and cancel any order between the time of placing it and 7 working days starting from the day after delivery.Cancellation must be made in writing by recorded delivery post to The Bike Shop (Leeds) Ltd, 78-84 Crossgates Road,Leeds,LS15 7NL or by email.To help us process your must iclude your name,address and order reference number. Once you have cancelled the contract you have a legal "duty of care" to take good care of the goods and return them to us at your expense.In accordance with the Distance Selling Regulations we will refund to you the full amount paid for the goods within 30 days of receipt of the notice of cancellation. We do not offer a collection service, all return postage charges will be the responsibility of the customer.

If you wish to complain.

All disputes arising out of or in connection with the contract shall be governed by English law and the buyer accepts the jurisdiction of the Courts of England. In the unlikely event that you should feel the need to complain, we will try our best to reach a satisfactory resolution for you.

Receipt of goods

Please check goods thoroughly before signing to say that you have received them in good condition. The delivery driver may try to rush you. Just ignore them and make a simple check for transit damage. This is very important as a claim against the carriers can only be made if the damage has been notified to the driver Do not amend the signature sheet in any way. The carriers will not accept any subsequent claim for goods signed for as "unchecked." Please note if you declare that you have received your item in good condition, it is difficult to later claim that your bicycle was in fact damaged in transit. If you do receive a bicycle which on inspection is unacceptably and substantially, damaged, refuse delivery of it. Do not sign for it and contact us immediately on 0113 2647693, giving a clear reason for refusal. We can then arrange for replacement goods to be sent out to you as soon as we receive and inspect the returned goods. You will not be charged for return unless,following our inspection, the goods are found to be undamaged. Please note that new cycles may have a slight cosmetic mark or scratch.These bikes are not manufacturers seconds,it is quite normal and many manufacturers now include additional transfers within the packaging ,to be used to cover such markes.Do not return your bike with a minor scratch,simply use the spare transfers or request some from us.

Our Guarantee Policy

All bicycles supplied by Bikes-by-mail-order conform to BS6102/1,when correctly assembled. Should any original component prove defective in terms of material deficiency, we will either replace or repair the component free of charge. "Competition" goods are supplied for specialist use and are subject to extreme wear and stress whilst in use. Life expectancy and durability are greatly reduced and purchasers should note that any claim for failure/wear shall be limited to that of the manufactures guarantees. It is agreed that such use shall be a relevant circumstance for the Sale of Goods Act 1979 (as amended). In addition, parts connected to parts supplied by this company may be placed under stress where specialist/competition parts are used, and purchasers should take advice from experts prior to purchase. Manufacturers may also limit guarantees when components are installed for competition use. All claims must be submitted to us in writing within the guarantee period stated on the accompanying manufacturers handbook. Bikes-by-mail-order's liability covers parts only,and does not cover labour charges from other cycle dealers, transportation charges or consequential loss. It is the responsibility of the purchaser to return the cycle or component to us for assessment, replacement, or repair,at their own cost. It is important that a simple visual inspection of the goods is carried out before signing to declare that you have received them in good condition. This guarantee does not cover the effects of normal wear and tear, or damage caused by accident, abuse or neglect. Read your handbook carefully and follow its advice. No bicycle is indestructible, and for this reason we are unable to guarantee cycles or components for any type of off road use, as damage is more likely to result. Our Warranty expressly excludes the following items tyres,inner tubes, light bulbs,batteries,and chains. Nothing in this policy prevents you from exercising your rights under the Sale of Goods Act 1979.

Special Orders

Special orders made to customers' specifications are excluded from the cancellation provisions of the Consumer Protection (Distance Selling) Regulations 2000.However,in the event that a special order item is found to be faulty please contact us either by telephone,email or post.We may then offer you an exchange or a monetary refund dependant on the nature of the problem.Original delivery costs will be refunded only if the item is faulty,damaged in delivery or it differs in any way from the advertised goods.Returned parcels remain the responsibility of the customer until safely received by us.The Company does not pay "return" carriage unless an item is faulty,or it differs in any way from the advertised goods.
